When does the 1.5× rate actually apply?

In New Zealand, time-and-a-half is not automatic for weekend or evening work. There are only two situations where the 1.5× rate is guaranteed:

  • You worked a public holiday. The Holidays Act 2003 mandates time-and-a-half for hours worked on any of NZ's 11 national public holidays — plus a paid alternative day off if it was an "otherwise working day" for you.
  • Your employment agreement promises it. Many hospitality, retail, security, and healthcare contracts include explicit penal rate clauses for nights, Sundays, or hours beyond 40/week. Double-check your individual or collective agreement.
